Getting Fired for Calling in sick?

    so i called up the restaurant saying i couldnt go to work tomomorrow morning cuz I was sick. And they were like "dont call last minute, we are gonna have to fire you" WTF? I thought this shit was illegal, and I didnt call in last minute cuz I called a whole day in advance. And how am I supposed to know when im gonna get sick? Then the guy is like "U dont soudn sick at all" Well im trying to sound respectable.

    The worse part is that a lot of people have called in sick and then I always have to go cover their shifts, and those poeple never got fired. But now I call in sick a day in advance and they are firing me...wtf???

    thats bullshit. Talk it over with your boss. If you're sick, you're allowed to call in sick, and frankly, I don't want sick people working in a restaurant that I'm dining in.

    I'd take it as a sign.
    Everytime I've lost a job it's only given me the opportunity to move on to better things.
    Take it as fate, that it's your time to move to something better.

    Besides, if they fired you for that, which was total bullshit, you definitely need to move on to something better.

    By law you should be getting a check within 24 hours of being fired, your state laws may vary but yes they have to pay you for time worked.

    Unfortunately since you are not under contract or in a union they can fire you for any reason they want, its legal. Call your boss back and explain your position, if he is short with you don't give him the satisfaction because this means he was just looking for an excuse anyways.

    Payback always comes into ones mind after something like this and it is very easy to do serious damage to a restaurant by picketing it routinely during high traffic hours (use your imagination on the signs) but probably not worth it to you. One picketer I seen in front of a fancy place here in Portland was a claim that the cook spit in his food, don't know if it was true but I can tell you the parking lot looked pretty empty.

    Depending on your state laws you should be able to still collect unemployment as this firing is totally unreasonable giving what you claim. You do have to call in which you did and as long as you have not abused that I think you are good to go.

    Around here employers can't pull that kind of shit, even with casual employees.
    We have a federal agency called the Office of the Employee Ombudsman... essentially a kind of BAD ASS who kicks the ass of shitty employers.
    Firstly, here you have every right to call in sick with 24 hours notice (no doctor's certificate required for 24 hours of sick leave).
    Second, if you've been with your employer for more than 12 months you have most of the same rights as a full-time employee.
    Too bad you live in a shitty place....
    What's the catchphrase? - liberty and justice for all????

    In Canada each province has a ministry of labour, and you would contact them regarding unreasonable firing. I imagine your state has something similar. 24 hours notice is bullshit too. If you wake up with projectile vomiting, they expect you to go to work in a restaurant because you can't call in at the last minute? That's nonsense, and probably against health regulations to make a sick person come into work in a restaurant. Sounds like the guy was looking for any excuse...especially if you were covering for other people that were sick. Best to move on and get another job.

    You got fired from a simple manual weekend and after school job?

    Wow... not sure how you managed that... it is not like you are captaining a cruise liner or managing multiple millions for an international company....:lol::lol:

    If you cannot keep a job loading dishes in a dish washer or waiting tables I would have serious doubts about you - I would not hire you to run or handle anything of importance.


    C I am sorry you have lost income, but this was a simple role not rocket building if you cannot retain that or move on amicably with a reference for the next job then you need to look at yourself too.:confused:


    I would go to the boss, get the money owed to me, ask what the real reason was and there are no hard feelings if he just tells you straight...
    Find out why he REALLY fired you and assess whether he had a point... if he did.. you learn and work on those points.. if not and he is just a tosser move on... BUT to get fired from such a simple job is a worry...

    I would like to hear his view.:naughty::naughty:
    If you get good, reliable help that is enthusiastic, smiles, keeps cool, chips in and is an asset to an owner... you simply do not get rid of them... :naughty:

    Of course if the owner turns out to just be a complete ass, then you move on with your pay and the knowledge that he just harmed his own business.:)

    I will advice to go and talk with your boss first thing when you will full recover from your illness.
    Yes, we experience a period with economy crisis (especialy here in my country) but i want to believe that at least he will give you a chance to talk to him.
    After all , as you wrote you was going there and help when others was ill.

    :) Michigan is an At-Will employment State, Meaning that unless you have a union to fight for you, an Employer can fire you for any reason and do not need to explain why.

    I have had a few dishwashing jobs in my youth, you work your ass off, but you are considered the lowest of the low. Actually I'm glad I had those jobs, they gave me a strong motivation to go to college and follow a more lucrative career path.
